Police: Utility Worker Urinated Near Defendant's Car Prior to Assault

New details emerge in Friday night's East Meadow assault.

The Levittown man who was arrested Tuesday for assaulting an out-of-state utility worker over the weekend may not have been completely at fault, police said at a press briefing Wednesday morning.

Nassau County Police Inspector Kenneth Lack said that the altercation between the two started when the defendant, 34-year-old Thomas Libretto, noticed the worker, 34-year-old John Applewhite, urinating in the vicinity of his car in the parking lot of Texas Roadhouse in East Meadow.

Police said the alleged urination started a verbal altercation between the two and led to Applewhite kicking gravel into Libretto's car. Lack said that Libretto then punched Applewhite in the face, breaking his nose and causing swelling to his eye.

The Huffington Post has reported that Applewhite needed a plate in his face and a wire in his jaw due to the severity of the assault."The proper procedure would have been to call the police," Lack said of Libretto's actions following the verbal altercation.

Nassau County Police arrested Libretto at his home Tuesday. He is being charged with assault in the third degree.

Lack added that Applewhite, who is currently in Florida, will not be charged for urinating in public.

Police said that Libretto has no prior arrest history and are unsure if alcohol played a part in the incident.

Lack said that witnesses were difficult to interview because of people going back to Florida.

Applewhite, of Tampa, Fla., was quoted in the Floridian newspaper The Ledger saying, "There is always a bad apple" -- referring to Libretto's actions. The quote was taken before any motive was released by police.

The guy kicked gravel onto the guy's car. The only probem with Mr. Libretto's behavior was the strength of his punch. Next time, he needs to punch the guy in the stomach.

I'm not violent but what the Florida guy did would piss,lol,most people off. Especially since there was a restroom nearby. 34 year olds acting like children lowlifes.

Hero carpenter defends the nabe from wanton urinators!....by punching him out..very nice. Guess what boys- in the world of adults, you use your fists, you go to jail. Time to grow up. And this'll be the hard way. Maybe the county will provide you a stay at the East Meadow jail. Get more practice with those fists. Chump.

Your all so ridiculous what has the mentally become? so he peed big deal, so it was near that low lifes car? so what it was a bmw? maybe people should not put so much value on something that becomes worth less the min. it drives off the lot and maybe put some stock ito using the brain they were given, So let me understand your thinking, he was the victim until the louse who punched him said he kicked gravel how many days later? I'm glad to know there was more to the initial story. No, it's not ok to punch someone in the face and it's also not ok to urinate in a busy suburban parking lot. Sounds like Applewhite should be charged. If he's not being charged because his punishment was getting punched, then maybe Libretto shouldn't be charged with anything. Sounds like 2 guys being jerks.

Urinating "near" a car and urinating "on" a car .. are 2 different things.. in the end, they both lose over something that was stupid.. sucks but now one has medical issues and one has legal issues... Nobody wins...
